TERMS AND CONDITIONS

1. Scope of Application

Valid for all orders received by telephone, fax, email, online shop, verbally, or in writing in our specialty stores of Feinbäckerei Walther, Lutz & Frank Walther GbR. All additional agreements require written form.

2. Conclusion of Contract and Order

Our product presentation does not constitute a binding offer but rather indicates the possibility to order the displayed product. The decoration is not part of the offer. Any order of a displayed product by the customer is a binding offer to conclude a purchase contract. The customer can place an order by telephone, fax, email, online shop, verbally, or in writing. In doing so, the customer is obliged to provide their name, first name, address, telephone number, and email address. This information must be provided truthfully. The purchase contract is concluded based on the valid prices as indicated at the time.

3. Prices and Shipping Costs

All prices are final prices including the currently valid value-added tax. The customer places orders for our products at the prices indicated at the time of ordering. Shipping costs include the costs of the transport company and additional shipping packaging and are weight-dependent. Shipping costs will be displayed on our website and can be requested by phone.

4. Delivery

Delivery is carried out by a transport company commissioned by us. Any desired delivery date will be considered; however, we cannot guarantee compliance with the desired delivery date. If not otherwise indicated, the delivery of our products will be made as soon as possible. This depends on our stock as well as the capabilities of the transport company. The customer must check the goods immediately upon receipt and report any damage promptly. In particular, the storage instructions for the products, as described on the website, must be observed. In the case of incorrect delivery addresses, non-attendance of the customer, refusal to accept the delivery, or non-collection of the package at the respective branch of the transport company, the customer is responsible and bears all costs.

5. Payment Method

Payment is made in Euros and is due immediately without deduction. For orders placed through our website, payment can only be made in advance. We will provide the customer with our bank details in the order confirmation. The shipment of the goods will be made after receipt of payment.

6. Retention of Title

The item remains the property of Feinbäckerei Walther, Lutz & Frank Walther GbR until full payment of the claim from the purchase contract.

 

7. Jurisdiction and Place of Fulfillment

The contract, the terms and conditions, as well as the entire legal relationship between us and the contracting party (customer) are subject to the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The sole place of jurisdiction and place of fulfillment is Dresden.

8. Data Protection

We store customer data for business processing and keep it confidential from third parties, except for the transport company. We adhere to legal regulations in processing customer data.

9. Right of Withdrawal and Return Policy

You have the right to revoke this contract within fourteen days without giving reasons. The revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods. There is no right of withdrawal for perishable foods or items that are not suitable for return due to reasons of health and hygiene.

10. Customer's Rights for Defects

In the case of a defect in the purchased item, the statutory provisions generally apply. The customer must immediately check the goods upon receipt and report any defects to the contracting party without delay. We reserve the right to subsequent performance or defect rectification and any claims for damages.

11. Alternative Dispute Resolution according to Art. 14 (1) ODR-VO and § 36 VSBG:

The European Commission provides a platform for online dispute resolution (ODR) that you can find at http://ec.europa.eu/consumers/odr/. We are not obligated to participate in a dispute resolution process before a consumer arbitration board and generally not willing to do so.

 

12. Final Provision

If individual provisions of the contract are or become invalid, the remaining provisions remain unaffected. The relevant statutory provisions apply in place of the invalid provision.
